As images are the tool that sells my services to my clients, all bookings are restricted to retained advertisement usage. All sessions are subject to the use of advertising including and not limited to this website, social media and any business advert to help promote my work and display my technical skills as per the creative commons act and my rights as the lifetime worldwide copyright holder of the images unless otherwise agreed in writing before the session and signed, dated and named by the photographer. As per worldwide copyright law, I retain the full copyright for life to all images that I take, process, digitally render, beauty retouch, creatively edit, process into print quality or have produced physically or digitally.

Removal of links from our website:
If you find any link on our website that is offensive for any reason, you are free to contact and inform us at any moment. We will consider requests to remove links, but we are not obligated to or so or to respond to you directly. We do not ensure that the information on this website is correct. We do not warrant its completeness or accuracy, nor do we promise to ensure that the website remains available or that the material on the website is kept up to date.

Parking, Pay & Display & Vehicle Access
Parking must be available at weddings to allow access to equipment and an area for breaks. If there are issues on the day with parking then this responsibility falls on the client to ensure that there is free or prepaid parking spaces available otherwise the time taken to find parking will be counted in your package and any fees associated with parking for your event will need to be covered by the client. If parking at any location for your wedding is paid, this will need to be covered

Wedding & Event Breaks:
Regular rest breaks are required throughout weddings and events to maintain physical stamina. This does include breaks to eat when working through lunch and dinner times. These breaks will be taken during quieter times as much as is possible and my meal breaks will be taken when the guests are eating as much as is possible. Extra breaks may be required depending on each individual day and any breaks will be taken as needed to maintain optimum shooting speed and stamina. Regular equipment changes are needed and regular trips to the car to change batteries, memory cards and equipment are needed throughout the day even when rest breaks are not taken. For more information on breaks, please see the section marked Wedding Breakfast Break & Vendor Meals.


Wedding Breakfast Break & Vendor Meals:
I do ask for a vendor meal to be provided when working through lunch and dinner or extra time will need to be allocated to leave the site and return with food. As per industry standard, I take my food break when the wedding breakfast is served and I do not take any images whilst the guests are eating all courses of the meal. Shooting resumes once the food is cleared away or the speeches begin. This is a planned and allocated break that has been taken into account in your package pricing. If you would like coverage throughout the meal then this needs to be pre-planned before booking and allowed for within your quoted price and extra time must be allocated within the day for me to stop and take my food break before or after yours depending on your schedule.

1 Year Free Rescheduling Terms:
If your booking was made during 2021 or 2022 then you may qualify for the free one-year rescheduling but terms do apply. All dates must be checked and agreed upon before any booking is made, or no dates can be guaranteed. This is limited to off-peak days only as bookings are taken so far in advance. There are no guarantees of any Saturday or Sunday bookings at any point of the year due to the nature of the business, so please get in touch before rebooking your venue. A change of heart does not count and proof of cancellation from your venue will be required to rebook without fees.



Price Changes
Sarah Brooksby Photography reserves the right to amend prices on the website, physically in print or anywhere listed online or offline due to errors or omissions without notice. Prices are correct at the time of publication but may change without notice with the exception of pre-paid bookings. Prices fluctuate naturally over time due to costs increasing or decreasing. The right to change the prices advertised is reserved and prices may be changed at any time without any notice given on the website. This does not alter confirmed bookings.

Wedding Package Item Changes
Printed products are provided for free with some promotional wedding packages or are available to purchase separately, however, Sarah Brooksby Photography reserves the right to exchange the printed items included for free with similar or better items from alternative suppliers should an issue arise with the supply or quality of supplied printed goods to the business that could jeopardise the quality or delivery of your goods. In the event of an issue with any supplier, Sarah Brooksby Photography reserves the right to change promotional, free or paid items included with your package at any time to similar or better items or services with similar specifications depending on what is available within the industry. If paid physical items are not available and there was no service or admin aspect to that payment, a full refund will be issued. Sarah Brooksby Photography will always strive to provide you with the exact products ordered, and where possible in the event of issues, items that have similar or better technical specifications or credit/gift cards for services of a greater value than the printed goods

VAT Increases

In the unlikely event of the Government raising the VAT rates, Sarah Brooksby Photography reserves the right to pass on VAT increases to the client since such changes are (a) outside the business' control (b) publicly known and verifiable and (c) universally applicable

Payment Charges
To cover the increased costs associated with physical banking and money laundering checks, an admin fee of £25 is due on any cash payments over £250 and is due on each payment or instalment made.


Free Items
No free items are guaranteed and are supplied as complimentary promotional items only. No warranty, monetary value or guarantee is given or implied and these cannot be returned or exchanged.

Returns & Refunds policy:
You are entitled to cancel your order within 30 days without giving any reason for doing so as long as personalized and customized print items have not begun processing, as once they have begun manufacturing, this process cannot be stopped and the goods are made custom to your order. Please be sure before ordering prints as they cannot be refunded, although every effort is made, unless I give you confirmation of cancellation within 12 hours of order the images will have gone to print.
The deadline for cancelling a print or USB order is 30 days from the date you received the goods or on which a third party you have appointed, who is not the carrier, takes possession of the product delivered
The deadline for cancelling a wedding service more than 60 days ahead is 45 days, for wedding bookings where the wedding date is less than 60 days after the booking, the cancellation period is 14 days
The deadline for cancelling a customized order is 24 hours from the date you placed the order as after this the prints cannot be cancelled
In order to exercise your right of cancellation, you must inform us of your decision by means of a clear statement in writing.

We will reimburse you no later than 30 days from the day on which we receive the returned goods. We will use the same means of payment as you used for the order, and you will not incur any fees for such reimbursement.
Hourly Services and free promotional goods are not eligible for returns or refunds.
Physical goods that arrive damaged must be returned to allow the business to claim damages from the delivery company. Once the return is back with the business, damaged goods can be exchanged but a refund is not available on personalised goods.
All returns are subject to a 20% restocking and handling fee.
Due to the nature of a digital delivery, once a file is delivered no refund is available and any digital delivery is final unless there is a fault with the files which prevent you from opening or viewing them as intended upon delivery, in which case the files will be re-processed and re-delivered to you free of charge

Conditions for returns:
In order for physical goods to be eligible for a return, please make sure that:
The goods were purchased in the last 30 days
The goods are as new in the original packaging
The goods were not personalised, printed or loaded with digital files rendering them used
The following goods cannot be returned: The supply of goods made to your specifications or clearly personalized, including prints, albums, presentation boxes, gift boxes, engraved USB drives & USB drives loaded with files or any other item printed with your image or customized to your order.
The supply of goods which are, after delivery, according to their nature are inseparably mixed with other items.
We reserve the right to refuse returns of any merchandise that does not meet the above return conditions at our sole discretion.

Returning Physical Goods
You are responsible for the cost and risk of returning the goods to us. You must get in touch to obtain an RMA and the details to return before returning any goods or returns will not be accepted. We cannot be held responsible for goods returned without an RMA, damaged or lost in return shipment. Therefore, we recommend an insured and trackable mail service. We are unable to issue a refund without actual receipt of the physical goods or proof of received return delivery with the correct supplied RMA details.

Copyright: The entire copyright for all photographs taken by SBP is retained by SBP at all times throughout the world. SBP also asserts her statutory right to be identified in the circumstances set out in Sections 77-79 of the Copyright, Designs and Patents Act 1988 or any amendment or re-enactment thereof. The client forfeits all commercial copyright to SBP, to publish, sell, use, print and distribute any images from the session without notice or further compensation. All images are retained for advertising.

Use: SBP’s written permission must be obtained before any non-private usage. The client will be authorised to privately use and print the photos. SBP retains the rights for the purposes of selling, publishing, submitting to competitions, advertising or otherwise promoting her work. Clients are prohibited from editing, manipulating or retouching the images without written consent from SBP. The client agrees to never misrepresent SBP by posting edited photographs online.

Indemnity: SBP agrees to indemnify the client against all expenses, damages, claims and legal costs arising out of any failure by SBP to obtain any clearances for which she was responsible in writing in respect of third-party copyright works, trademarks, designs or other intellectual property. In all other cases, the client is responsible. Subjects are advised to take all creative directions and requests as suggestion only and follow their own safety precautions, health limitations & common sense to prevent injury or damage to property, guests and clients. Clients agree to indemnify SBP against such scenarios except for applicable law.

Applicable Law: This agreement shall be governed by the laws of England and Terms and Conditions shall not be varied except by agreement in writing. Your statutory rights are not affected. Any disputes must be settled in the photographer’s home territory of Norfolk.

Privacy: Any phone numbers or addresses provided are in the strictest of confidence and will not be sold for marketing purposes, ever.

Privacy Promise: Your information and photos are never kept in an unsecure or unsafe way, and everything in SBP’s power is done to protect your photographs and data. SBP’s goal is always to keep your data private and safe. No data is ever sold.

Stored Data: All information given is kept in the strictest of confidence and in accordance to the GDPR regulations. All data stored is for SBP’s business usage only. Data is never sold to third party companies. If you would like your information removed from the system once your event is over and your photos have been delivered to you, please inform Sarah Brooksby Photography in writing. Please note that all wedding albums are kept on file for as long as possible but this is a free service and cannot be guaranteed without paying for lifetime wedding album storage upon delivery of the wedding album due to the nature of long-term file storage.

Cancellation: Postponement is preferred to cancellation and will always be attempted before any refunds are offered. SBP will still require full payment if the client cancels last minute. The client will receive a full refund if SBP cancels, but the client’s liability on cancellation shall be limited to a full refund of all monies paid and no further compensation or other financial liabilities. SBP will endeavour to keep the appointment, even if it means SBP is late, delayed, ill, re-arranges or postpones or is without certain equipment. Postponed bookings are subject to price increases through inflation and will be charged at SBP’s current rate. Booking fees are transferable if you postpone but additional admin fees may apply. Cancellation before the notice period set out above in this document equals a full refund of all monies paid. Due to the nature of photography, the sooner a client cancels, the more chance that another can be booked in to avoid heavy financial loss. This is reflected in the sliding scale of refund percentages for cancellation. SBP attempts to offer fairer financial terms than the UK wedding industry standard by offering a 45-day cancellation period for standard bookings and 14 days for last minute bookings. If the client cancels outside of the notice periods, any money paid is forfeit and the photographer's liability on cancellation shall be limited to no further compensation due or other financial liabilities. If the client terminates the photographer's coverage early on the day, the client is not entitled to any pro-rata refund and is limited to no further compensation due or other financial liabilities. In the event that the client chooses to cancel the client agrees to indemnify the photographer from any legal claims or disputes related to that event.

Electronic Signatures & Contracts: Visiting the Site, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communication be in writing. You hereby agree to the use of electronic signatures, contracts, orders and other records and to electronic delivery of notices, policies and records of transactions initiated or completed by us or via the Site. You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records, or to payments or the granting of credits by other than electronic means.

Disputes: Disputes or complaints will be dealt with in private between the client and the photographer.

Payment: Booking fees are non-refundable as they cover the admin and booking process immediately after payment. Payment in full is expected at least 6 weeks prior to the event or SBP reserves the right to cancel with no refund of any monies paid. Late fees are due to cover the additional admin required for any late payments. All sales are final and no refunds are given or implied. The service fee is refundable upon cancelation subject to a sliding scale fee set out in this document.

Rejection: There is no right to reject on the basis of style, creativity or composition. SBP has 100% complete creative control over the images, style, composition and editing, and the client agrees to accept SBP’s individual photographic style and SBP’s candid, natural documentary shooting style by booking with her. Due to the nature of event photography and documentary style shooting; quality and style may vary and nothing is guaranteed. When including candid and natural memories, some will be deemed as ‘non perfect’ with blinkers, yawners or content deemed as non-perfect unless the client requests a smaller ‘perfect’ album. No quality, colour, lighting, style, group images, poses or requested images are guaranteed due to the nature of event photography. SBP does not guarantee that any images will come out free of noise, glare, blurred movement or other common problems that can be associated with lighting, fast moving subjects or difficult environmental factors and the client has no rights to reject based on the above or any circumstances beyond the photographer’s control. No verbal or written agreements of the above are guarantees.

Disputes & Complaints Procedure: Any disputes regarding photographs must be raised within 48 hours of receipt of the proof album, any disputes regarding prints must be raised within 24 hours of delivery and disputes regarding the service must be raised within 48 hours of the booking date before work begins on your album and will be investigated by a third-party consultant and responded to within 14 working days.

Force Majeure: In the unlikely event of total photographic failure on the day or Sarah Brooksby being personally incapacitated and unable to attend the shoot beyond control, the client shall be limited to a full refund of all monies paid for the photo shoot. The booking fee is non-refundable except when cancellation is the fault of SBP as this service is payment for the planning, booking, research, meetings and creative meetings. SBP holds no further liability to the client, either financial or otherwise. Your statutory rights are not affected. If SBP brings the contract to an end without justification the client is entitled to a full refund of all monies paid and it is SBP who bears the risk. Due to the nature of the service offered and how the work is partially carried out before the date of the photo shoot, if a client brings a contract to an end without justification leading to loss suffered or the photographer has to terminate the contract due to a breach of the terms and conditions, including but not limited to the terms set out in 'ABUSE' the client cannot expect a full refund of sums paid; in these circumstances it is the customer who bears the risk. Within the notice period that is set out in this contract, a full refund of all unused services is available to the client. SBP will strive to maintain good health, equipment and transport and meet the client’s needs as much as is reasonably and economically possible

Notice of working with others and of dangerous activities booked at your wedding or event: The photographer is always happy to work with other wedding professionals where it is agreed before the event and sees it as a wonderful way to extend the memories that you are capturing of your wedding day to cherish, but SBP does require advanced warning and notice of other vendor bookings to allow us to work around each other in a productive way. Charges may be due if your booking requires additional planning time or meetings to discuss the additional vendors that weren't discussed during booking. SBP reserves the right to refuse service and to terminate the booking without any refund due to the client due to a breach in terms if no notice is given of other vendors before the wedding or event itself. SBP reserves the right to change terms of service on the day if additional vendors are present that weren't declared prior to the date. SBP reserves the right for the job to be recalculated and to have the terms adjusted as needed around any additional vendor(s) that weren't declared during the time of booking. SBP cannot be held responsible for any missed shots, bad angles or compromises made in shooting due to the presence of other services or vendors that compromise the photography - this includes but is not limited to videographers, photographers, drone operators, performers or any other professional or service working alongside the wedding day that may cause or contribute to blurred or motion blurred shots, bad poses, missed shots, bad angles or compromises made in shooting or otherwise alter the service that is normally given. Images may be different to what was expected or missed altogether due to the other professional(s) and SBP cannot be held responsible for any effect on the final wedding album. SBP retains the right to refuse to work with any particular service or vendor without disclosing the reason to the client to prevent any breach in confidentiality with past clients or vendors under the terms of the GDPR. SBP reserves the right to refuse service when working with others when it may negatively affect the quality and content of an album or where the terms of a vendor's service clash with the terms of SBP's service or would cause copyright infringement, intellectual property theft or issues with clearances and permissions, or where the attendance of any vendor or service would inhibit the performance of the photographer or cause distress, harm, injury, abuse, exploitation, danger to life, threat, harassment, sexual harassment or otherwise negatively affect the photographer or the service given to the client. Due to explosive batteries, equipment and strobe lighting, clients must inform SBP of any risk-taking activities or of any dangerous vendor activities booked for the event or wedding, including but not limited to: adrenaline activities, boats, pedal boats, canoes, water activities, fire, fireworks, smoke bombs, sparklers, firebreathers, high rope performers, explosions, liquid ice, smoke machines, animal exhibitions, zoo exhibitions, dangerous animals in attendance, pets in attendance, horses in attendance, cows present at the venue especially when with young or pregnant or any other event or service that is dangerous in nature that you require to be photographed or for the photographer to be around. Clients must inform SBP if any guests are attending who will be taking photos or recording video over the wedding day even if their primary reason for attending is as a guest. SBP requires you to declare all cameras present during the wedding ceremony so that the camera operators can work together to create beautiful memories without hindering each other's photographs. If any camera operators jump out into the aisle or frame, cause missing or bad shots or cause any other issues with your wedding album outside of SBP's control, SBP cannot accept any responsibility and all other camera operators are the client's responsibility where they are not employed by SBP. All clients agree to declare any and all camera operators, paid or unpaid before the wedding day itself or these terms will be breached and the service may be terminated depending on the vendor booked, the service that they are providing and each individual circumstance.

Expenses: Where extra expenses or overtime are incurred as a result of circumstances beyond the photographer’s control or alterations to the original brief by the client, the client shall give approval to and be liable to pay such extra fees at SBP’s normal current rate. This includes parking fees, any fees needed to perform your service, any additional planning meetings outside of the normal client requirements, additional planning meetings for 3rd party vendors, creative planning and briefing outside of the normal requirements of a client and any additional time needed to complete your service if your booked timings over run on the day. Any overtime will be charged at the standard hourly rate of £275.00 & any images taken during paid overtime are provided fully retouched and edited after full payment is received. SBP reserves the right to withhold any images taken during overtime if the overtime rate is not covered in full after the wedding, but SBP will always endeavour to let you approve these charges first where it is possible without effecting your event - for example, if you run into overtime midway through a wedding ceremony, I will continue to shoot without stopping the service and asking you first and you can refuse or purchase those images after the wedding.

Travel & Parking: Travel fees are due for services outside of the business base area and the price for travel is based on the average cost of fuel and the distance to your venue. When booking in advance, travel fees will not be charged until the year of the booking to ensure that if the price fluctuates you do not end up paying more than the costs of the travel. Where it is required to travel from one venue to another, the photographer cannot be held responsible for time, traffic or parking issues. If the photographer cannot park safely then an alternative arrangement will be needed to continue with your service. The car must be close by, legally and safely parked to allow access to equipment, batteries, memory cards and other needed bits that cannot be carried on a person. If the photographer cannot get parked at your chosen venue, a suitable nearby alternative will be found at the expense of the client and equipment will need to be transported to the location and stored in a secured room at the venue. Please note that parking is assumed to be free unless a client has specified otherwise before booking and any fees, permits or pay and display charges are the client’s responsibility and these are not included within any package pricing. Please note that any time used by parking or sorting out parking is beyond the photographer’s control and the photographer cannot be held responsible for any delay in arriving with you due to parking issues at the venue. A fixed dash cam is used to record trips midway through a booking for monitoring and training purposes and is kept on file for 24 hours after the booking.

Group Shots & Specific Shots: No specific shot or group is guaranteed. Due to the nature of event photography, it may not be possible to get every individual shot that you request for reasons beyond the photographer’s control. The photographer will do everything in her power to obtain specific shots for clients but due to the nature of photography, no single shot can ever be guaranteed. It is the client’s responsibility to ensure that guests are in the right place at the right time for group shots, to ensure that no guests wander off, to ensure that they are completed in a timely manner, to ensure cooperation from guests, to ensure that no group shots are missed, to ensure that the group shots are completed later in the day if any are missed and to ensure that enough time is booked in the day for group shots. Each individual group shot takes 5 minutes on average to setup and take. If time is not made for the missed group shots later in the day, no shots will be included and that is the client’s responsibility. If the client, venue or guests’ requests to end the group shots early, that is the client’s responsibility. Group shots are often the part of the day where things will over-run as it can be hard for the couple to keep their guests in one place without wandering off – this can cause the guest shot schedule to run late and for shots to be missed in circumstances beyond the photographer’s control.

Wall Worthy Portraits: To guarantee you the inclusion of wall worthy portraits in your wedding album, a 45–60-minute window is required within the event without family or guests present. If there is not enough time, if you are distracted, if the venue calls you to stop or if things have to be cut short on the day, then the inclusion of wall worthy portraits cannot be guaranteed. If the couple request to end the couple session early on the day, then it is the couple’s responsibility if there are any missed shots, poses or images and if the portraits are incomplete.

Abuse & Safe Working Environment: We all have the right to a safe workplace and being self-employed is no different. The photographer has a right to work without abuse, intimidation, harassment, physical threats, discrimination, disability discrimination, age discrimination, sex discrimination, bullying, sexual harassment, sexual threats, slander, anti-social behaviour, threats of violence, threats of intimidation, threats of harassment, threats of defamation, threats of libel, threats to property, threats to equipment, threats of physical harm and any other anti-social behaviour by clients, family, guests, staff, pets or any other person attending the event that may compromise the photographers ability to perform the service to the usual high standards. Any financial loss caused by clients, guests or attendees will be passed on and charged to the client. Incidents will be reported to the police in full and any relevant authorities. The clients are expected to fully assist with any police investigation and to provide full names and details of any individuals to the photographer if there are any issues. The photographer reserves the right to refuse service if any terms in this clause are broken and the photographer will terminate this contract instantly and you will not be entitled to a refund. The client also understands and agrees that the photographer is not obligated to continue to perform under this agreement if the photographer’s personal safety or well-being has been or will be comprised or threatened at the event, including, but not limited to, the conduct of any attendee of the event or for any reason listed within this clause.

Complying With Government Laws: The client understands that the photographer works to maintain a safe work environment, including but not limited to, complying with applicable governmental laws, directives, lockdowns, pandemic special measures, orders, and regulations. The client further understands and agrees that photographer shall not be required to perform under this agreement if the event is held in violation of a governmental order or photographer’s participation in the event would violate a governmental order. The client also understands and agrees that the photographer is not obligated to continue to perform under this agreement if the photographer’s personal safety or well-being has been or will be comprised or threatened at the event, including, but not limited to, as a result of the condition of the venue for the event or any reason which would directly violate laws.

Prints, USB and Printed Products: Prints and USB drives are subject to availability and the exact specification of these items may change in the event that the items are no longer available from the suppliers or if the item has been discontinued. In the event of an item not being available, a suitable alternative or goodwill gesture will be offered. Each client on the print list is given a timescale to order prints within and if this deadline is missed, there are late fees due and you will lose your priority place within the que. Any price increases with my supplier or services due to clients making late orders must be covered by the client. Prints, photobooks and USB drives are personalised items and once a client has approved the order the items may not be returned or refunded unless they have arrived damaged.

Print Timescales
Print orders are put in at the end of each month so if your deadline falls at the beginning of the month, you will be at the top of the que for the next month's print order. The system works on a first ordered first served basis where the orders are prioritised in the order that they are submitted so if your order is late, your processing and delivery will be affected. The average wait for prints to come back to the studio is 6-8 weeks but it can take longer during extremely busy periods or bank holidays. If you need prints by a certain date please get in touch and I will contact the printers and see what the current turnaround time is.

Gifts:
If the goods were marked as a gift when purchased and then shipped directly to you via email or mail, you'll receive a gift credit for the value of your return. Once the returned product is received, a gift certificate will be emailed to you. If the goods weren't marked as a gift when purchased, or the gift giver had the order shipped to themselves to give it to you later, we will send the refund to the gift giver. Gift cards must be redeemed by the date stated on the gift card. Gift cards are non-refundable or exchangeable.
